Personal Data Protection Policy

REERACOEN VIETNAM CO., LTD (“we”, “us”, or “our”) acknowledge our responsibility as a company which provides 1) support for employment and career change, 2) temporary staffing, and 3) content production and website development.
Under the basic philosophy that we faithfully fulfill customers’ needs and contribute to society, we acknowledge the importance of client information, and implement as well as maintain the following terms:

  1. We work on appropriate protection of the personal information of our job applicants (users), client companies and our employees by assigning a “Personal Data Protection Department”.
  2. We obtain, use and provide personal information based upon appropriate methods only within the scope necessary for our business operation. When obtaining personal information, we clarify its purpose of use to the information’s owner and provide contact information for inquiries on processing of such information.
  3. In principle, except for legal orders, we only use personal information for the purpose indicated above. We shall take appropriate and necessary measures to prevent unauthorized use of such information.
  4. We take reasonable security measures to prevent and remedy risks such as unauthorized access to personal information or loss, damage, falsification, defamation or divulgation of personal information.
  5. In case we delegate the task dealing with personal information to partner companies, we make contracts with terms consistent with this Policy and Decree 13/2023/ND-CP and laws, regulations on personal data protection (“Laws on Personal Data Protection”) and provide necessary instructions to those companies to make sure that they use, provide and maintain the information according to the agreements made when such information is obtained.
  6. We will promptly respond to complaints or inquiries regarding the collection and processing of personal information. Upon receiving a request for disclosure, correction, change or deletion, we will promptly provide reasonable instructions for these requests after having the necessary verification.
  7. We comply with legal regulations, instructions of competent authorities and other regulations regarding personal information that we have processed and are processing. We continue to retain, improve and carry out necessary maintenance and upgrades to ensure that the personal information security management system works well.

3. Definitions

“Personal Data” are information in the form of symbols, letters, numbers, images, sounds or similar forms in an electronic environment that is associated with a specific person or helps to identify a specific person. Personal Data include Basic Personal Data and Sensitive Personal Data.

“Basic Personal Data” includes: a) Surname, middle name and birth name, other names (if any); b) Date of birth; date of death or disappearance; c) Gender; d) Place of birth, place of birth registration, permanent residence, temporary address, current address, hometown, contact address; dd) Nationality; e) personal photo; g) Phone number, identity card number, personal identification number, passport number, driver's license number, license plate number, personal tax code number, social insurance number, health insurance card number; h) Marital status; i) Information about family relationships (parents, children); k) Information about the individual's digital account; personal data reflecting activities and history of activities in cyberspace; l) Other information associated with a specific person or helping to identify a specific person that is not Sensitive Personal Data.

“Sensitive Personal Data” is personal data related to an individual's privacy that, when violated, will directly affect the individual's legitimate rights and interests, including: a) Political views, religious views; b) Health status and private information recorded in medical records, excluding information on blood type; c) Information related to racial origin, ethnic origin; d) Information on inherited or acquired genetic characteristics of an individual; e) Information on individual's physical attributes, biological characteristics; e) Information on individual's sex life, sexual orientation; g) Data on crimes, criminal acts collected and stored by law enforcement agencies; h) Customer information of credit institutions, foreign bank branches, intermediary payment service providers, and other permitted organizations, including: customer identification information as prescribed by law, account information, deposit information, deposited assets information, transaction information, information on organizations and individuals who are guarantors at credit institutions, bank branches, and intermediary payment service providers; i) Data on individual location determined through positioning services; k) Other personal data as prescribed by law as specific and requiring necessary security measures.

“Data Subject” is the individual with whom Personal Data is associated.

“Candidate” represents all individuals who are looking for a job and want to apply for a job position of the Company or the Company’s Clients.

“Personal Data Processing” or “Data Processing” is one or more activities that affect data such as collecting, recording, analyzing, validating, storing, editing, publishing, combining, accessing, retrieving, withdrawing, encrypting, decrypting, copying, sharing, transmitting, providing, transferring, deleting, destroying personal data or other related actions.

4. Types of Personal Data collected and means of collecting Personal Data
  1. Types of Personal Data collected

    In order for the Company to conduct its recruitment activities, the Company and/or the data processors it authorizes may need and/or be required to collect Personal Data, including: (i) Basic Personal Data and (ii) Sensitive Personal Data relating to Candidates.

    1. Basic Personal Data includes: Surname, middle name and birth name, Other names (if any); Date of birth; Gender; Place of birth; Place of birth registration; Permanent address; Temporary address; Current address; Hometown; Contact address; Nationality; Personal image; Phone number; Identity card number; Personal identification number; Passport number; Driver's license number; Vehicle license plate number; Personal tax code; Social insurance number; Health insurance card number; Marital status; Information about family relationships (parents, children); Information about personal digital accounts; Data about personal activities on cyberspace and other related information.
    2. Sensitive Personal Data includes: Information on ethnic origin; Criminal records issued by competent authorities;
    3. Information about the Candidate's education, work history and professional experience (including references), contact information and other information that the Candidate proactively provides through the CV/Resume or Application form; and information showing that the Candidate is suitable for the position he/she applied for.

      Note: When the Candidate provides Personal Data of any Third Party to us (family members, references/previous supervisors of the Candidate), the Candidate represents and warrants that the Candidate has obtained the necessary consent or permission from such Third Party to share and transfer their personal data to us for processing in accordance with this Policy.

    4. In the event that a Candidate is invited and participates in tests or competency assessments depending on the requirements of the recruitment position, or depending on the nature of the position, “Personal Data” also means the information provided by the Candidate during the test or the answers, assessment results, as well as the Candidate’s final results, scores and personal profile characteristics, including personality factors and soft skills (such as the ability to work in a team, creativity, assertiveness, reliability, adaptability), logical skills, performance, language skills, level of understanding, including audio or video recordings (where the Candidate had been made aware of and consents to the recording and video recording) or other relevant information.
    5. Interviewer comments and observations during the recruitment process.
    6. Recruitment information (including copies of employment rights documents, references and other information contained in the CV or cover letter or as part of the application process); and
    7. Any other information the Company holds relating to the Candidate.
  2. Means of collecting Personal Data

    The Company and/or its authorized data processors may collect personal data of Candidates in the following ways:

    1. Provided by Candidates to the Company
    2. Posted publicly by Candidates through profiles created on employment-related social media platforms and job boards (such as LinkedIn, Anphabe, or Facebook);
    3. Provided by third parties, such as recruitment service providers, or Candidates' former employers and credit information providers with the Candidates' consent;
    4. Through the Company's partners, including Personal Data that Candidates directly provide to Partners and Personal Data that Candidates provide to Partners through the Company's website/job postings; and
    5. Through those who have contacted the Company with enquiries.
5. Purpose of Processing Personal Data
  1. Personal Data collected from Candidates is used to:

    • Answer questions as required
    • Create an account directly on the Company's website/application.
    • Provide our services (support for job search - job transfer, temporary staff and profiles on related websites)
    • Provide information about our services (support for job and career change, temporary staff and profiles on related websites)
    • Assist Candidates in collecting necessary qualifications in the work area
    • Contact Candidates on issues related to our services
    • Send surveys or information about events, campaigns, mass emails or campaign prizes
    • Provide service information related to new services, third-party services, acting as an intermediary for users' applications for such services, managing the status of such applications and reporting to users
    • Communicate with Candidates on related issues
  2. Personal Data collected by our partners is used to:

    • Recruit for partners using our services
    • Store part of the candidate information received from partners to maintain the content and quality of our software services (website)
    • Send surveys or event information, campaigns, bulk emails or campaign prizes
    • Provide service information related to new services, third-party services, act as an intermediary for users' applications for such services, manage the status of such applications and report to users
    • Contact, cooperate, and negotiate with parties, execute contracts and perform obligations
    • Exercise our rights and obligations based on commercial law
  3. Personal Data of Candidates applied for positions at our company is used to:

    • Screen, interview, contact with Candidates on related issues
    • Recruit, provide salary and benefits, contact with employees on related issues
  4. Personal Data provided by people who contact us with enquiries is used to:

    • Answer questions as required.
6. Job information introduction

In case having the Candidate’s permission, the Company will provide job information in the form of recruitment notices if there is any job suitable for the user.

Means: Via text message, email, announcement on the Company's website or other means as prescribed by law.

Frequency: According to the legal regulations on advertising.

In addition to the above regulations, the Company is responsible for complying with the legal regulations on advertising (if any).

7. Means of Processing Personal Data

Depending on the time and depending on the above purposes, the Company and/or the data processor it authorizes may perform one or more activities affecting personal data, such as: collecting, recording, analyzing, validating, storing, editing, publicizing, combining, accessing, retrieving, withdrawing, encrypting, decrypting, copying, sharing, transmitting, providing, transferring, deleting, destroying personal data or other related actions.

Personal Data Processing activities may be performed by the Company in an automated or non-automated manner, by electronic means or manual methods or any other way that the Company and/or the data processor it authorizes deems appropriate.

8. Personal Data Entrustment

The Personal Data we obtain may be entrusted to third parties within the scope of the “Purpose of Processing Personal Data” section set out above. All third parties will have to sign a Non-disclosure agreement with us.

9. Shared Use of Personal Data

The Personal Data that we may be shared for using, limited to the following areas:

    4. Personal Data obtained from people who have contacted us with enquiries, is used jointly because:

10. Transfer of Personal Data abroad
  1. Purposes for transferring Personal Data abroad

    The Company will/may transfer the Candidate's Personal Data abroad for one or more of the following purposes:

    • Manage Candidate information and recruitment processes as in the case of shared use of Personal Data mentioned in Section 8 of this Table; and
    • Other purposes will be specifically announced when necessary.
  2. Means of transferring Personal Data abroad

    Depending on the time and depending on the above purposes, the Company may transfer Personal Data by electronic means or manual methods or any other means that the Company deems appropriate.

11. Start and end time of Personal Data Processing
  1. Data processing start time:

    The Company will start processing personal data from the moment of receipt of such personal data.

  2. Data processing end time:

    Until the purposes set out in Section 5 and Section 10.1 of this Table are fulfilled or until it’s necessary to comply with legal obligations and to resolve any disputes or until the Candidate requests deletion of the information provided.

12. Rights and obligations of Data Owners
  1. Rights of Data Owners

    Under the Personal Data Protection Law, as a Data Owners, the Candidate has the following rights:

    1. Right to know
    2. Right to consent
    3. Right to access
    4. Right to withdraw consent
    5. Right to data erasure
    6. Right to limit data processing
    7. Right to request data provision
    8. Right to object to data processing
    9. Right to complain, denounce, initiate a lawsuit
    10. Right to claim compensation for damages
    11. Right to self-defense

    Candidates may agree to part or all of the Data Protection Policy for Candidates. In case of partial agreement, please contact the Personal Data Protection Department.

    When a Candidate wishes to access and/or correct or delete the Candidate's Personal Data currently held or controlled by the Company, in order to be able to deal with the Candidate's request, the Company will need to have sufficient information of the Candidate to determine the identity and nature of the Candidate's request.

    In the event that the Candidate withdraws his/her consent, requests deletion of data and/or exercises other relevant rights in respect of any or all of the Candidate's Personal Data, actions taken by the Candidate under this provision may mean that the Company cannot fulfill the purposes set out in Section 5 and Section 10.1 of this Table.

  2. Obligations of Data Owners

    Under the Personal Data Protection Law, as a Data Owners, the Candidate has the following obligations :

    1. Protect his/her own Personal Data; request other relevant organizations and individuals to protect his/her Personal Data;
    2. Respect and protect the Personal Data of others;
    3. Provide complete and accurate Personal Data when agreeing to allow the processing of Personal Data;
    4. Comply with the provisions of the law on personal data protection and participate in preventing and combating violations of the provisions on personal data protection.
13. Authorisation

Candidates have the right to allow or not allow to provide Personal Data. However, if you do not consent or provide incomplete data, you may have difficulty using our services or resolving your queries. We will also not be liable for any damage or loss suffered by the Data Subject as a result of refusing to provide us with Personal Data.

14. Collection of unidentifiable information belonging to Personal Data

Some of our websites use cookies to protect user privacy, improve content, advertising, and collect statistical data. The following items may be included when collecting information using cookies or JavaScript. However, no Personal Data is included in cookies, browser history.

  1. Non-personally identifiable data collected includes: Age, gender, occupation, area of ​​residence (not identifiable even when all items are combined)
  2. Device information
  3. User access history on our websites: URLs visited, content, order of reference
  4. Location information based on user agreement or application when using mobile phones

15. Call recording

We may record calls to better understand and respond to comments and requests and to improve our services in the future. Recorded data will be deleted as soon as it is no longer needed.

16. Personal Data Protection

We take reasonable technical and administrative measures to prevent and mitigate the risk of loss, damage, destruction or disclosure of Personal Data obtained.

To the best of our ability, access to Candidates' Personal Data is limited to those who need to know. Individuals with access to the data are required to maintain the confidentiality of such information.

17. Consequences, unexpected damages that may occur
  1. Although the Company will do its best to protect the Personal Data of Candidates, the transfer and storage of information is vulnerable to unauthorized third-party activities. Some of the unintended consequences and damages may include, but are not limited to:

    1. Hardware and software errors during data processing cause data loss for the service provider;
    2. Security vulnerabilities beyond our control, the system is attacked by a third party causing data leakage;
    3. Service providers arbitrarily disclose Personal Data due to: carelessness or fraud; accessing websites/downloading applications containing malware...
  2. In the rare case of an unexpected incident or a violation of personal data is discovered, the Company will notify the relevant parties of the incident/violation within the time limit prescribed by law, and will make every effort to remedy and prevent consequences and damage to the minimum extent within the Company's capabilities and following current laws.

19. Policy amendments and supplements

The Company reserves the right to update this Candidate Personal Data Protection Policy from time to time if necessary. Notification of any amendments, updates or modifications will be communicated to the Candidate by the Company through such means of communication as the Company deems appropriate.
